West Point man charged with selling meth

David Leonard Daniels (Cullman Police Department)

WEST POINT -  A West Point man was arrested on Tuesday, Jan. 22, charged with three counts of unlawful distribution of a controlled substance for allegedly selling methamphetamine.

David Leonard Daniels, 50, was arrested by members of the Cullman Police Department’s Crime Suppression Unit and the Alabama Drug Enforcement Task Force.

Daniels was booked into the Cullman County Detention Center and has since made bond.

Surrett pleads guilty in 2017 hit and run death of Good Hope woman

CULLMAN - Days ahead of a jury trial scheduled to begin this week, Larry Dewayne Surrett entered a plea of guilty to the charge of leaving the scene of an accident involving injury or death in the Mother's Day 2017 death of Good Hope resident Helen Virginia Duke, 75. 

According to the initial report from Alabama State Troopers, Duke was struck on Schwaiger Road in Good Hope on May 14, 2017 by an unknown vehicle which fled the scene. After Duke’s body was discovered in a ditch near her mailbox, along with evidence of the vehicle, authorities searched for a Ford vehicle with a broken passenger side rear view mirror.  Surrett was picked up on May 31, 2017.

A grand jury indicted Surrett on three charges:

  • Leaving the scene of an accident involving injury or death.  Alabama Code 32-10-1 reads “The driver of any motor vehicle involved in an accident resulting in injury to or the death of any person, or in damage to a motor vehicle or other vehicle which is driven or attended by any person, shall immediately stop such vehicle at the scene of such accident or as close thereto as possible and shall then forthwith return to and in every event shall remain at the scene of the accident until he or she has fulfilled the requirements of Section 32-10-3. Every such stop shall be made without obstructing traffic more than is necessary.”
  • Driving with a revoked driver’s license.
  • Tampering with evidence.  The state charged that Surrett replaced the grill, headlight, passenger side fender and passenger side mirror of his 1999 Ford Expedition in order to hinder the investigation.

Surrett’s plea was only to the first charge of leaving the scene of an accident, which is a Class C felony.  The other charges are both misdemeanors and could possibly be dismissed if the plea is accepted, but not necessarily so. 

According to a source at the Cullman County Courthouse, Surrett entered what is known as a blind plea: he pled guilty without negotiating any sort of deal with the State.  Judges are not required to be lenient in such cases.

A Class C felony can carry a prison sentence from one year and one day up to 10 years, and can be affected by various issues including circumstances of the crime and previous criminal history. Courts can also impose restitution.

Surrett’s sentencing hearing is scheduled for March 21, 2019.

MONTGOMERY - Alabama Attorney General Steve Marshall on Tuesday informed the Hoover Police Department and the Alabama State Bureau of Investigation that he has concluded that the Hoover police officer who shot and killed Emantic “E.J.” Bradford Jr. at the Riverchase Galleria mall on Nov. 22, 2018, did not commit a crime under Alabama law and thus will not be criminally charged for his actions.   The Attorney General further noted that it was his understanding that the Federal Bureau of Investigation had reviewed the matter and found no evidence to initiate a case against the officer for civil rights violation(s).

Also on Tuesday, the Attorney General’s Office showed surveillance video of the shooting death of E.J. Bradford Jr. to Bradford’s parents and attorneys, who had requested to be shown the video and to have it released to the public.

MONTGOMERY - Cullman County Human Trafficking Task Force Chairperson Kathy Wilson represented the Cullman area, sitting on a panel and discussing developing community awareness at the 2019 Alabama State Human Trafficking Summit in Montgomery on Friday.  She sent The Tribune this report:

The fifth annual Alabama Human Trafficking Summit was held today in Montgomery, Alabama, with record attendance of 296-plus participants.  Alabama Attorney General Steve Marshall addressed the group with words of encouragement and praise for the efforts Alabama has made to combat human trafficking.

This year’s summit focused on labor trafficking.  Polaris Project provides the following information for labor trafficking:

Labor traffickers – including recruiters, contractors, employers, and others – use violence, threats, lies, debt bondage, or other forms of coercion to force people to work against their will in many different industries.

Labor traffickers often make false promises of a high-paying job or exciting education or travel opportunities to lure people into horrendous working conditions. Yet, victims find that the reality of their jobs proves to be far different than promised and must frequently work long hours for little to no pay. Their employers exert such physical or psychological control – including physical abuse, debt bondage, confiscation of passports or money – that the victim believes they have no other choice but to continue working for that employer.

U.S. citizens, foreign nationals, women, men, children, and LGBTQ individuals can be victims of labor trafficking. Vulnerable populations are frequently targeted by traffickers. Immigration status, recruitment debt, isolation, poverty, and a lack of strong labor protections are just some of the vulnerabilities that can lead to labor trafficking.

Labor trafficking occurs in numerous industries in the U.S. and globally. In the United States, common types of labor trafficking include people forced to work in homes as domestic servants, farmworkers coerced through violence as they harvest crops, or factory workers held in inhumane conditions. Labor trafficking has also been reported in door-to-door sales crews, restaurants, construction work, carnivals, and even health and beauty services.

Key Statistics

  • Globally, the International Labor Organization estimates that there are 20.1 million people trapped in forced labor in industries including agriculture, construction, domestic work and manufacturing.
  • The U.S. Department of Labor has identified 148 goods from 76 countries made by forced and child labor.
  • Since 2007, the National Human Trafficking Hotline, operated by Polaris, received reports of more than 7,800 labor trafficking cases inside the United States.

Bremen man charged in arson, burglaries, assault of law enforcement officers

PROSPECT/MT. JOY - A Bremen man has been charged with multiple offenses stemming from an event Friday night in the Prospect/Mt. Joy area in which he allegedly set fire to two homes, burglarized properties and assaulted multiple law enforcement officers.

According to a statement from the Cullman County Sheriff’s Office (CCSO), Matthew Eli Aaron, 36, has been charged with second-degree arson, two counts of second-degree assault, third-degree burglary and resisting arrest. The CCSO said there will be additional charges added.

Authorities received a call from a local fire department that a field was on fire at the intersection of County Road 8 and County Road 35 Friday evening. When firefighters responded, a man, later identified as Aaron, refused to allow them to extinguish the fire. Aaron also allegedly threatened several firefighters. The CCSO said Aaron left the field by the time deputies arrived. He allegedly threatened several residents who came to assist the firefighters.

A search for Aaron ensued, upon which CCSO deputies discovered that he allegedly burglarized and broke into several homes in the area of County Road 8 and County Road 35.

“As deputies were speaking with one homeowner that just had their home damaged by Mr. Aaron, they noticed fire and smoke coming from another residence nearby,” said the statement from the CCSO. “Deputies quickly arrived and saw the house was indeed on fire. Deputies then made entry into the home to make sure no one (was) inside the residence.”

Deputies located Aaron as they made their way to the back side of the residence, said the CCSO, which said Aaron was inside a screened-in porch.  

“After quickly coming into contact with the deputies, Mr. Aaron discarded the firearm he had in his possession and he did not follow any other lawful orders and began to assault the deputies and investigators,” said the statement. “After several minutes of resisting arrest and assaulting the deputies, Mr. Aaron was handcuffed and placed in the back of a patrol car and transported to the Cullman County Detention Center (CCDC).”

Aaron allegedly resisted law enforcement further upon arrival at the detention center, where he allegedly attempted to assault CCSO deputies, detention deputies and Cullman Police officers.

“I am very thankful for the deputies (and) detention deputies, as well as the CPD officers and many firefighters who assisted in the arrest of this suspect and also help(ed) get him detained once he arrived here at the detention center. I have also spoken to District Attorney Wilson Blaylock about this incident, and his office and the sheriff’s office will do everything we can for the victims and citizens in the Prospect/Mt. Joy area,” said Sheriff Matt Gentry.  “I’m proud of the relentless effort by our deputies and assistance from community members in Mr. Aaron’s apprehension.”

Aaron is currently being treated at Cullman Regional for drug-related issues and smoke inhalation. He is being held without bond. Charges are pending in other jurisdictions relating to these cases.

2 charged with trafficking illegal drugs; stolen car recovered

NEW CANAAN - Deputies with the Cullman County Sheriff’s Office (CCSO) on Sunday arrested Joseph Bradley Sivley, 35, and Angela Beth Reed Stillwell, 30, both of Arab, for allegedly trafficking illegal drugs.

Sivley was charged with trafficking in illegal drugs, unlawful possession of controlled substance, first-degree receiving stolen property, carrying a pistol without a license and possession of drug paraphernalia. Stillwell was charged with trafficking in illegal drugs, unlawful possession of controlled substance  and possession of drug paraphernalia.

According to a media release from the CCSO, the drug bust happened in the New Canaan community after deputies were conducting a follow-up investigation in the area.

“A deputy pulled up at a residence on County Road 1807 after (the) CCSO had gotten several tips from residents that illegal activity could be taking place in the area. Once the deputy was at the residence, he located a stolen vehicle and also located two individuals who were the drivers of the vehicle and were later identified as Mr. Sivley and Ms. Stillwell,” said the release.

The arrests netted 6.85 grams of oxycodone, 6.6 grams of methamphetamine, a stolen 2008 Nissan Altima, five morphine pills, a Smith & Wesson SD9 VE pistol and drug paraphernalia.  

“These two arrests and recovery of someone’s stolen vehicle were made possible by our deputies being proactive law enforcement officers, following up on tips from citizens and noticing when something is out of place,” said Sheriff Matt Gentry.  “I would like to say that seizing this many pills and meth off these dealers before it made it into the hands of others is a good day for drug enforcement as well.”

Sivley and Stillwell have both made bond.
