Cullman Police make multiple drug distribution arrests

CULLMAN - The Cullman Police Department’s Crime Suppression Unit (CSU) has made multiple distribution arrests recently, in separate incidents.

On Dec. 26, the CSU, along with members of the Alabama Drug Enforcement Task Force (ADETF), arrested Damien Christopher Hausler, 36, of Cullman County. He was charged with three counts of unlawful distribution of a controlled substance for allegedly selling hydrocodone pills and marijuana. 

Hausler has since made bond. 

In a separate case, on Jan. 2, the CSU, along with members of the ADETF, arrested Diane Fay Mendez Lopez, 33, and Eric David Goodman, 49, both of Cullman County. Each was charged with unlawful distribution of a controlled substance for allegedly selling methamphetamine. 

Lopez and Goodman have since made bond. 

In a third case, on Jan. 3, the CSU and members of the ADETF arrested Cristina Lynn Schafer, 40, and Steven Paul Harris, 39 at their residence in Vinemont. Each was charged with three counts of unlawful distribution of a controlled substance for allegedly selling methamphetamine. 

Harris was on parole at the time of his arrest and had outstanding parole violation warrants. He remains incarcerated in the Cullman County Detention Center. 

Schafer has since made bond.

Cullman County man’s bond revoked in manslaughter case

CULLMAN - On Friday morning, Cullman County Circuit Judge Gregory Nicholas revoked the bond of Donald Wayne Trammell, 43, of Jones Chapel in the manslaughter case stemming from the shooting death of Trammell’s son in December 2017.  Trammell led police on a high-speed chase on the night of Dec. 31, 2018, leading to multiple new charges. Additionally, he faces charges of both violating a protection order and stalking his estranged wife on two separate occasions.

Timeline of events

  • On Dec. 24, 2017, shooting at his own truck which, according to Trammell, he thought was being stolen, the defendant struck and killed his son, Logan Trammell, who was driving the truck.  In Feb. 2018, Donald Trammell was indicted by a grand jury for manslaughter, case CC-2018-230, and was released on bond.
  • In Oct. 2018, Trammell’s wife filed for a protection from abuse order, claiming that Trammell had committed violent acts against her.  The request was granted, and Trammell was served with the protection order on Nov. 2.
  • On Nov. 5, Cullman Police discovered Trammell in a car across the street from his estranged wife’s place of employment, dressed in camouflage clothing, with binoculars, a pocket knife and other tools.  The time was before work hours, and police concluded that he was waiting on his wife to arrive. Trammell argued that he was meeting a friend to go view hunting land. He was arrested and charged with violation of a domestic violence protection order and second-degree stalking.
  • On Nov. 7, Assistant District Attorney John Bryant filed a motion to revoke Trammell’s bond in the manslaughter case, in response to the new charges.  A warrant was issued for Trammell’s arrest. He was located and arrested on Nov. 14. He spent 14 days in jail and was released on Nov. 28 with his bond reinstated.  Among the conditions of his release was an agreement to submit to a psychiatric evaluation. Court records do not show whether such an evaluation has taken place.
  • On Dec. 6, Trammell was found near his in-laws’ home where his wife was reportedly staying.  According to the police report, he was “lying in wait and watching the victim with binoculars.”  According to a letter sent by Trammell to the court, “I was going to stop and talk to my mother and father in law.  I pulled off the side of (***) at the end of their road to make sure my wife was not there!”  Later in the letter, he insisted, “I have never nor will I ever have any bad intentions or plans to harm or threaten her in any way.”
  • On Dec. 7, ADA Jeremy Cline filed a new motion to revoke Trammell’s bond, claiming, “The criminal actions of the Defendant constitute a violation of the terms and conditions of the Defendant’s bond in these cases,” that “The Defendant is a flight risk, as shown by his evasion of law enforcement prior to his arrest on the State’s previous motion to revoke the Defendant’s bond that was filed on November 7, 2018,” and that “The Defendant is a threat to community safety.”  The motion was granted the same day by Cullman County District Judge Wells “Rusty” Turner.
  • On Dec. 14, Turner issued an order for an alias warrant (warrant for suspects who fail to appear in court or respond to court orders) for Trammell.
  • On Dec. 31, Trammell led three Cullman police officers on a high-speed chase along a route that included U.S. Highway 278, Interstate 65, Alabama Highway 157 and St. Joseph Drive and ended near the Cullman Housing Authority at the intersection of First Street Southwest and 13th Avenue Southwest. Trammell was arrested and charged with attempting to elude, reckless endangerment, second-degree unlawful possession of marijuana and multiple traffic violations.

At Friday morning’s hearing, Judge Nicholas heard from Sgt. Cole Kelley, Investigator Justin Craft and Sgt. Chris Thomason, the three Cullman Police officers who pursued and apprehended Trammell on Dec. 31; he was also shown Kelley’s bodycam footage from the incident.  All three officers agreed that speeds during the chase were often between 80 and 100 miles per hour. A search of Trammell’s truck yielded a small bottle containing marijuana under the driver’s seat.

After the officers’ testimony, ADA Bryant introduced a copy of the protection from abuse order, along with the previous charges against Trammell.  Defense attorneys Johnny Berry and Brandon Little did not present witnesses but argued for dismissal on the grounds that Trammell had not been properly informed of an amended list of charges and, therefore, had been denied due process.  Judge Nicholas offered the defense team a continuation of the case, to give them more time to respond to the amended charges, but it declined. With that, the judge revoked Trammell’s bond, noting that his alleged behavior appeared to constitute a threat to himself and others.

Cullman Police report rash of vehicles break-ins

CULLMAN -  Cullman Police say a number of vehicles have been broken into recently and one stolen. Reports show two incidents on Monday and five on Tuesday this week. All have been on the city’s southwest side, first on Cherokee Avenue and then in the area of Greenbriar Drive.

According to Sgt. Todd Chiaranda, “In the early morning hours of Jan. 8, 2019, property was stolen from several vehicles in the Greenbriar Drive area of southwest Cullman. Six victims who live within a few blocks of each other reported a number of items were taken from their vehicles, which were parked in their driveways. The total reported loss thus far is in excess of $850.”

Chiaranda said a car was also stolen.

“A 2003 Toyota Corolla was also stolen from one of the residences. The vehicle was later recovered where it was abandoned in the Warrior area,” he said.

Chiaranda urges citizens to come forward if they have been victimized.

“I encourage anyone who is a victim and has not yet reported the crime, please do so. The recovery of your property may be the evidence needed to identify and charge the persons who committed these crimes.

“A trio of thieves can hit several neighborhoods in just a few hours with little chance of alerting their victims, spending less than a minute in each vehicle they find unsecure. I cannot emphasize enough the importance of simple preventative measures such as locking vehicle doors, not leaving valuables visible from the outside of the vehicle and not leaving keys in the vehicle’s ignition. Prevention is the best strategy.”

Ed Henry pleads guilty to theft of government property

MONTGOMERY -  On Wednesday, Jan. 16, 2019, former Alabama State Rep. William “Ed” Henry pleaded guilty to one count of theft of government property, announced U.S. Attorney Louis V. Franklin, Sr. The conviction arises out of Henry’s involvement in a scheme to defraud Medicare.

According to court documents, when he committed his offense, Henry was the chief executive officer of an Alabama-based company, MyPractice24. MyPractice24 provided chronic care management services to Medicare Part B beneficiaries, specifically patients with two or more chronic conditions. Physicians could hire MyPractice24 to perform chronic care management for their patients, and the physicians were required to collect co-pays from such patients of approximately $8 per month. Medicare would then reimburse the physicians at approximately $32 per patient per month.

On behalf of MyPractice24, Henry entered into contracts with the practices of various doctors around the southeast, including Alabama physicians Gilberto Sanchez, Punuru J. Reddy, and Nicole Scruggs, to provide chronic care management services for those doctors’ patients. Each doctor agreed with Henry that his or her practice would waive co-pay requirements for patients participating in MyPractice24’s chronic care management program. Ultimately, Sanchez obtained approximately $119,349.11 from the United States government; Reddy obtained approximately $77,705.26; and Scruggs obtained approximately $7,060.87. Because the physicians systematically waived patient co-pays for chronic care management services, the physicians were not entitled to be reimbursed for those services.

Henry’s sentencing will be scheduled at some point in the coming months before Chief United States District Judge W. Keith Watkins. At sentencing, Henry faces up to ten years in prison, a fine of not more than $250,000, and up to three years of supervised release.

“Henry and his co-defendants treated seriously ill patients as vehicles for getting money from the government,” commented United States Attorney Franklin. “In doing so, they diverted precious health care resources from paying for health care services that were truly necessary to services that Henry could make a profit from providing. I am proud of the investigative agencies’ efforts to expose this fraud.”

The United States Department of Health and Human Services-Office of the Inspector General, the Drug Enforcement Administration, and the Internal Revenue Service-Criminal

Investigation Division investigated this case. Assistant United States Attorneys Jonathan S. Ross and Megan A. Kirkpatrick prosecuted the case.

Cullman Police investigating armed robbery at Hwy. 278W/I-65 Chevron; 1 injured

CULLMAN - Cullman Police are investigating an armed robbery that occurred at the Chevron gas station on U.S. Highway 278 West and Interstate 65 in the early morning hours of Thursday, Jan. 24, according to CPD Captain of Investigation Becky Boyd.

At approximately 3 a.m., two African American males entered the store. "They attempted with a tow strap to pull the ATM out of the store," said Boyd. "They were not successful."

The female clerk was pistol whipped by the suspects, said Boyd. She was checked out by Cullman EMS by did not require treatment at the hospital.

"There was an amount of money that was taken from the store," said Boyd.

Boyd said the men were wearings masks, gloves and hoodies and driving a small red SUV with considerable damage to the driver's side door.

Anyone with information is asked to call 256-775-7170. Sgt. Eric Cole is the lead investigator.
