Suspect in custody in Friday’s Traditions Bank robbery

CULLMAN - The suspect in Friday’s robbery of Traditions Bank is in custody. The man, identified only as a middle-aged white male, is currently being interrogated by Cullman Police Department investigators, according to CPD Capt. of Investigation Becky Boyd.

The incident happened at approximately 10:15 Friday morning at the main branch of Traditions Bank in downtown Cullman. The bank is located at 109 Second Ave. NW.

Lt. Gene Bates is leading the investigation.

The department is not releasing any additional details yet, as it is an active investigation.

“I can’t tell you anything yet, except we had a bank robbery this morning and the suspect is in custody,” said Boyd, who also confirmed, “There were no injuries. Everyone is safe.”

The Tribune has reached out to Traditions Bank President Tim Compton, and is awaiting more information.

Suspect arrested, ID’d in Traditions Bank robbery

CULLMAN - A Hanceville man is behind bars, charged with first-degree robbery, after he allegedly robbed Traditions Bank in downtown Cullman Friday morning.

According to Cullman Police Department Lt. Gene Bates, on Friday, Oct. 6, shortly after 10 a.m., a white male, now identified as Joseph Lee Phillips, 49, entered the bank, located at 109 Second Ave. NW and passed a note to a teller demanding money. Phillips claimed to be armed, but there was no weapon visible to bank employees. He obtained an undisclosed amount of money and left the bank. Bates said Phillips had parked his vehicle, a Jeep Liberty, in the bank’s parking lot. He left the bank driving south on U.S. Highway 31.

Bates said Officer Brandon Patterson, who was off duty but in town for departmental business, made contact with the Jeep, prior to the description being released, and stopped the vehicle for a traffic violation. As soon as the description of the suspect and vehicle went out, Patterson immediately recognized the suspect as the individual he had just stopped. He provided the information to investigators, who were then able to locate Phillips and the Jeep at a family member’s residence.

Phillips was arrested for first-degree robbery and an outstanding misdemeanor warrant with Cullman County Sheriff’s Office. He is currently being held in Cullman County Detention Center on a $60,000 property bond for the robbery charge; however, he is being held without bond on the CCSO warrant.

“I would like to commend Officer Patterson for a job well done. Even though he wasn’t on duty in terms of his patrol shift, he still monitored he radio and CAD System (computer aided dispatch) which is what allowed us to quickly make an arrest in this case,” said Bates. “You often hear the saying that an officer is never really off duty; well this is a perfect example of this being true.”

Brad Meeks indicted for reckless murder for wreck that killed CHS student Curtis Wilson

CULLMAN - Bradford Neal Meeks, the man who has been at the center of the investigation into the fatal car crash that claimed the life of Cullman High School student and athlete Curtis James Wilson, 15, on Sunday, May 7, 2017, has been indicted by a grand jury for reckless murder. Meeks was indicted in Cullman County last week and today, Tuesday, Oct. 10, 2017, he turned himself in to the Cullman County Detention Center. Meeks is charged with reckless murder, DUI .08 or greater, DUI, unsafe lane change, driving on wrong side of the road, possession of open container of alcoholic beverages in a motor vehicle and third-degree assault. He has made bond, which was set at $150,000 property by Cullman County Circuit Judge Martha Williams.

Toxicology reports from UAB Hospital revealed that Meeks, 27, of Cullman, the driver of the truck that hit Wilson and his mother, Ashley Wilson, 43, had a blood alcohol content (BAC) of .256, approximately three times the legal limit, at the time of the wreck.

The case has been the source of much scrutiny, with many in the community expressing frustration with what they perceived as the wheels of justice moving too slowly. But according to Cullman County District Attorney Wilson Blaylock, his office had to wait for all of the information to come in before moving forward. The investigation was handled by the Alabama Law Enforcement Agency (ALEA), and toxicology reports run through the state forensics lab.

Said Blaylock, “It’s a case that we waited to have all the facts before us before we presented it to the grand jury. We kept the immediate family informed all along the way. Now starts the process of the prosecution.”

Blaylock said Meeks will be arraigned in roughly three weeks, but it could be several months before the trial begins.

According to Alabama Code Alabama Code Title 13A. Criminal Code § 13A-6-2, a person commits reckless murder if  “(2) Under circumstances manifesting extreme indifference to human life, he or she recklessly engages in conduct which creates a grave risk of death to a person other than himself or herself, and thereby causes the death of another person.”

Alcohol has been suspected as a factor in the crash since it occurred, with a report from ALEA the day after the wreck stating, "Although the circumstances surrounding the crash are still under investigation, preliminary investigation indicates alcohol may have been a factor in the crash."

The Cullman Tribune learned from several sources shortly following the fatal incident that Meeks was allegedly driving erratically prior to the crash and that he allegedly made statements on the scene that led law enforcement to believe he was not sober. Additionally, Meeks has an extensive criminal history with at least two previous DUI charges.

On May 18, Ashley Wilson filed a wrongful death suit against Meeks. The document filed with the court alleges that, at the time of the incident, Meeks was driving “negligently, wantonly, recklessly and/or otherwise unreasonably;” and that he was “unfit to drive and/or failed to maintain control of his vehicle.”  She also filed against her own insurance providers Allstate and Alfa, demanding payment on underinsured motorist claims.

In June, all three defendants responded to the suit in documents submitted to the court.  Meeks, on June 5, through his attorney Gaynor St. John, made a “general denial” of Wilson’s allegations, pleading that Meeks’ actions behind the wheel were not negligent, but instead were the result of a “sudden emergency.”

Allstate Insurance, on June 5, through its attorney Cornelius Warren, denied Wilson’s claim.  Included in its response were allegations that Wilson failed to state claims that could be paid, and also that her claims failed to meet the statute of limitations.  Furthermore, Allstate charged Wilson with “contributory negligence,” a legal term alleging that her actions during the incident contributed to her own injuries and her son’s death.

The Tribune reached out to an attorney for more on what exactly the “contributory negligence" claim means.

According to Birmingham-based attorney Tracy Miller, who is not associated with the case, "Contributory negligence is a standard affirmative defense that is deemed waived if not pled in a defendant’s answer. The mother’s complaint and the answers filed by the defendants in response thereto are called pleadings, and both have formal, legal requirements that may not make much sense to someone not engaged in the practice of law. It does not mean the facts and evidence obtained during the discovery process will show the mother was negligent or that any of the defendants actually believe she was negligent. The defendants must assert all affirmative defenses now and determine through discovery if any defenses actually apply to the case.”

Alfa Insurance, on June 2, through its attorney Michael Haggard, denied Wilson’s claim on constitutional grounds, arguing that the punitive damages she seeks violate due process and equal protection clauses in the U.S. and Alabama constitutions.  It also denied that the accident was caused by an underinsured motorist.

Both Insurance companies admitted that Wilson had underinsured motorist coverage with them, and both requested set-off: the right to withhold payment until they find out how much the other defendants will be required to pay, and to determine their required amounts accordingly.

Ashley Wilson is being represented by Birmingham attorney Gregory Martin Zarzaur.

“We all are devastated by Curtis's death and are still grieving as a family,” Ashley Wilson said. “He was an absolutely wonderful son, brother, grandson, nephew.  We are still looking for answers surrounding his death and we hope to find them soon.  He was deeply loved and we miss him every single second of every single day.”

On June 22, Meeks’ attorneys filed a motion to stay, requesting a stay/delay in the civil case until after any criminal case is pursued, as his attorney feels that evidence that comes out in the civil case might point toward his guilt in a criminal case.

The motion states, in part, “Meeks has a reasonable apprehension that he cannot defend himself in this action without surrendering his constitutionally protected privilege against self-incrimination, or, if he asserts his Fifth Amendment privilege in this civil action, creating an adverse inference against him. In short, Meeks’ privilege against self-incrimination will be violated unless this Court grant the relief requested.”

Curtis Wilson was a passenger in a 2004 GMC that collided head-on with a 2008 Ford driven by Meeks. The teen was transported to Children's of Alabama in Birmingham by helicopter from the scene of the wreck, where he later died from his injuries. The incident occurred just after 6 p.m. on Sunday, May 7 in the 2000 block of County Road 222 in front of Van's Sporting Goods.

The driver of the GMC, Ashley Wilson, was transported to Cullman Regional by ambulance for treatment of her injuries. Meeks was airlifted to UAB Hospital in Birmingham.

Troopers also identified a third vehicle involved. The driver of that vehicle, Lisa Hebert, 50, of Gardendale was not injured.

Curtis Wilson, who was a sophomore at Cullman High School, was the second area student to be killed by a suspected drunk driver this year. On March 28, Tonya J. Busbee, 34, of Bremen and her daughter, Rhianna Busbee, 13, a student at Cold Springs, died after being hit head on by another driver on County Road 813. The driver who hit the Busbees was Jonathan Biggs, 53, of Dayton, Ohio. Biggs was also indicted for reckless murder last week, according to Blaylock. The Tribune is working to gather the details in that case.

Vinemont man arrested for distributing meth

VINEMONT - A Vinemont man was arrested after allegedly selling methamphetamine to undercover officers.

According to a media release from the Cullman Police Department, James Britton Steele, 41, was arrested on Oct. 5 after an undercover operation conducted by CPD Sgt. Chris Thomason and Officers Cole Kelley and Dustin.

During the operation, officers did a controlled buy, during which Steele allegedly sold them methamphetamine. 

Steele was arrested and charged with unlawful distribution of a controlled substance and jailed in the Cullman County Detention Center on a $20,000 property bond. Steele has since made bond.

Vinemont resident arrested for meth distribution

VINEMONT - Another Cullman County resident is behind bars for distribution of methamphetamine. Chadwick Keith Wynn, 37, of Vinemont is being held in the Cullman County Detention Center.

The Cullman Police Department says Wynn was arrested on Wednesday, Oct. 11 by Sgt. Chris Thomason and Officers Dustin Colburn, Trey Higginbotham and Cole Kelley after Wynn allegedly sold methamphetamine during controlled buys on two separate occasions.

He is charged with two counts of unlawful distribution of a controlled substance, unlawful possession of a controlled substance and possession of drug paraphernalia.

Berlin man sentenced to more than 10 years in federal prison on meth distribution charge

CULLMAN - A Berlin man was sentenced this week to 10 years and 10 months in federal prison for unlawful possession with intent to distribute 5 grams or more of methamphetamine. United States District Judge L. Scott Coogler sentenced Jeffery Lee Cunningham, 47, on Oct. 10, 2017, to 130 months in prison, stemming from his January 2017 arrest in Cullman County.

Further, the judge ruled that upon release from prison, Cunningham will be on supervised release for a term of 120 months, or 10 years.  

Cullman Narcotics Enforcement Team (CNET) and Drug Enforcement Agency (DEA) agents arrested Cunningham at his residence on County Road 759 on Jan. 30, 2017, where they recovered 1.5 ounces of meth. Agents discovered the meth in a toilet in the residence before it could be destroyed. Cunningham was charged then with trafficking in methamphetamine.

“As I stated at that time we knew this suspect was a known drug dealer and I am glad we were able to work with DEA to get him off the streets. I am glad that the DEA was able to adopt this case and now this suspect will be in prison for many years,” said Sheriff Matt Gentry.  “Again, I would also like to commend CNET and the DEA on the work they did in assuring this suspect is no longer a menace to our county.”

Under federal truth in sentencing laws, Cunningham will have to serve at least 85 percent of his sentence.

2 area women arrested for meth distribution

CULLMAN -  Two area women were arrested recently, in two separate and unrelated incidents, for meth distribution.

The first incident occurred on Oct. 7, when the Cullman Police Department’s Sgt. Chris Thomason, Investigator Justin Craft, and Officers Trey Higginbotham, Cole Kelley and Dustin Colburn conducted an undercover operation in which Melissa Kay Rock, 42, of Huntsville allegedly sold a half ounce (approximately 14 grams) of methamphetamine to the officers. 

Rock was arrested for unlawful distribution of a controlled substance, unlawful possession of a controlled substance and unlawful possession of drug paraphernalia. At the time of her arrest, Rock was also served with two outstanding felony warrants for two additional counts of unlawful distribution of a controlled substance. The CPD said the outstanding warrants stemmed from a previous sale of meth to the same undercover officers.

Rock, who has been living in Cullman for a short while, was placed in the Cullman County Detention Center and has since made bond.

The second incident occurred on Oct. 11, when Thomason, Higginbotham, Colburn and Kelley arrested Megan Nail James, 33, of Cullman, who is also alleged to have sold methamphetamine to undercover CPD officers on two separate occasions.

James was out on bond for a previous arrest when she was arrested on Oct. 11. This time she was charged with two counts of unlawful distribution of a controlled substance.

James remains incarcerated in the Cullman County Detention Center on a $60,000 property bond.

Hanceville woman arrested for selling meth to undercover cops

CULLMAN - A Hanceville woman was arrested this week after she allegedly sold methamphetamine to undercover officers.

Regina Banks Edwards, 49, of Hanceville was arrested and charged with three counts of unlawful distribution of a controlled substance on Oct. 17 by the Cullman Police Department.

Sgt. Chris Thomason and Officers Trey Higginbotham, Dustin Colburn and Cole Kelley made the arrest after conducting an undercover operation in which Edwards allegedly sold the meth to them in three controlled buys.

Edwards was transported to the Cullman County Detention Center where she was held on a $65,000 bond. She has since bonded out.

Traffic stop nets stolen weapon, counterfeit currency

CULLMAN - A traffic stop on Oct. 11 led to the arrest of Daniel Stewart Cochran, 44, of Cullman after a search allegedly yielded a stolen weapon and counterfeit currency.

Cullman Police Department Sgt. Chris Thomason and Officer Dustin Colburn stopped the driver, identified as Cochran, of a pickup truck for a traffic infraction on St. Joseph Street Northwest.  During the stop, Thomason and Colburn gained consent to search the vehicle and allegedly recovered a stolen rifle from inside the truck. Counterfeit U.S. currency was allegedly discovered on Cochran’s person.

Cochran also had multiple warrants with another law enforcement agency. 

Cochran was charged with fourth-degree receiving stolen property and first-degree criminal possession of a forged instrument, as well as the outstanding warrants. 

He remains behind bars at the Cullman County Detention Center.
