Grandmother of suspect in Osborn murder facing charge in case

Susan Smith, the grandmother of murder suspect Andrew Maresh, was arrested for hindering prosecution in the case. Authorities say she knew the victim was buried on her property in Fairview. (Cullman County Sheriff’s Office)

CULLMAN - The grandmother of one of the men accused of the murder of Hartselle man Daniel Ray Osborn II, 22, was arrested recently and charged with first-degree hindering prosecution, according to court documents.

Osborn’s body was found buried on the property of Susan Winton Smith, 65, of Fairview on March 26. Tyler Stephen Hudson, 20, of Baileyton and Andrew Jacob Maresh, 19, of Hartselle were arrested and charged with murder that same night. Authorities recovered the body of Osborn, who had last been seen by his family on Feb. 3, 2018, from Smith’s property on County Road 1534 in the Fairview community. Court documents revealed that Osborn died of a gunshot wound to the back of his head.

Smith, who is the grandmother of Maresh, “did conceal the body of Daniel Ray Osborn II,” according to the District Court complaint on file.

The complaint states: “On or about February 3, 2018, Susan Winton Smith was advised by her grandson, Andrew Maresh, and Tyler Hudson that they had killed Daniel Ray Osborn and buried him in her yard on CR 1534.  Since then, Susan Smith never advised anyone, to include the Cullman County Sheriff’s Office and/or the Hartselle Police Department of the murder/buried body of Mr. Osborn. On March 29, 2018, Susan Smith was arrested for Hindering Prosecution 1st Degree and booked in the Cullman County Detention Center.”

Smith was assigned a $10,000 property bond and was released after bond was posted.

Maresh was assigned a bond of $25,000 cash, which has not yet been paid.  He remains in the Cullman County Detention Center. The bail request placed before Judge Kim Chaney stated that:

  • “The offender is out on bond on an unrelated drug offense.”  According to other court documents, the offense included possession of marijuana, possession of a controlled substance (Alprazolam), and additionally included possession of multiple counterfeit bills.
  • “The offender admitted to being involved in a murder on February 3, 2018.”
  • “The listed offender has made threats toward the co-defendant as well as witnesses to this case.”

Hudson was assigned a bond of $15,000 cash, also unpaid, and remains in the Cullman County Detention Center.  The bail request placed before Judge Kim Chaney stated that:

  • “The listed offender stated that he is in fear of his own life and that he would commit suicide due to the fact that he couldn’t live with what he had done.”
  • “The offender admitted to being involved in a murder on February 3, 2018.”

Authorities from the Cullman County Sheriff's Office, Hartselle Police Department and Cullman County Coroner's Office worked together to recover Osborn’s body in Fairview.

On March 27, the Cullman County Sheriff’s Office said in a statement, “(On) Monday, March 26, 2018, Cullman County Sheriff’s (Office) ‘CCSO’ investigators and Hartselle Police Department investigators responded to an address in the Fairview community, Cullman County. This response was from several weeks of a relentless investigation of a missing person’s case that was initiated in the Hartselle community.  Sadly, in the course of the investigation, the victim’s body was discovered buried at the residence.”

The statement said that after the discovery of the victim’s body, investigators, working in conjunction with the Cullman County District Attorney’s Office, continued the investigation throughout the night.

“I would like to commend the hard work and dedication from the Hartselle Investigators and the Investigators from the Cullman County Sheriff’s Office in working this case together. Our prayers go out to the victim’s family during this time of tragedy and loss,” said Cullman County Sheriff Matt Gentry.

Vinemont woman charged after meth, syringes found in home with 3 small children

VINEMONT - A Vinemont woman was arrested Tuesday and charged with three counts of chemical endangerment of a child after authorities allegedly found methamphetamine and syringes in a home where three small children were present.

Investigators with the Cullman County Sheriff’s Office (CCSO) arrested Angela Michelle Simpers, 29, following an investigation with the Cullman County Department of Human Resources.

A media release from the CCSO stated that methamphetamine was being used by the offender within the residence in the presence of the children: “During the course of the investigation it was confirmed that methamphetamine and syringes were present within the residence and being used around the children.”

The three children in the residence are all younger than 10-years-old. 

“As sheriff our children will always be a top priority. This is a good example of agencies working together to protect our most valuable resource,” said Sheriff Matt Gentry.

Simpers remains in the Cullman County Detention Center on a $30,000 bond.

Pair arrested in Cullman for trafficking methamphetamine

CULLMAN - The Cullman Police Department's Crime Suppression Unit arrested and charged two people with trafficking in methamphetamine following a traffic stop Thursday.

According to a media release from the department, during the traffic stop, officers gained consent to search the vehicle and allegedly recovered approximately 37 grams of methamphetamine, along with marijuana, two handguns and various pieces of drug paraphernalia.

Both the driver, Henry Ennis Sellman, III, 35, of Vinemont, and passenger, Rebecca Anne Prater, 38, of Falkville, were arrested. 

Sellman has been charged with trafficking in methamphetamine, certain persons forbidden to possess a pistol, possession of a firearm with an altered identification number, second-degree unlawful possession of marijuana and unlawful possession of drug paraphernalia. Prater was charged with trafficking in methamphetamine and unlawful possession of drug paraphernalia. 

Both Sellman and Prater remain in the Cullman County Detention Center, each on a $1 million bond.

Search warrant leads to 4 meth trafficking arrests

WHITE CITY -  Four men were arrested for trafficking on Friday after a search warrant yielded drugs and drug paraphernalia, said the Cullman County Sheriff’s Office.

The Cullman Narcotics Enforcement Team (CNET) executed a search warrant at a residence on County Road 604 in the community of White City, where agents allegedly discovered marijuana, drug paraphernalia and approximately 4 ounces of meth.

Agents arrested David Jerry Reynolds 37, Damian Alan Blair, 39, Robert Earl Brock 58, and Steven Ray Moore, 32, at the residence.  All the suspects were charged with trafficking in methamphetamine, second-degree unlawful possession of marijuana and unlawful possession of drug paraphernalia.      

“This case is a great example of being vigilant and working together as a team.  Anytime you can seize this much methamphetamine you know it’s keeping it out of the hands of our children,” said Cullman County Sheriff Matt Gentry. “I want to thank the investigators and deputies for their hard work in this case.”

Reynolds and Blair are each being held on a $200,400 property bond. Brock is being held on a $100,000 property bond. Moore has bonded out.

UPDATED: CVS on Cherokee robbed; CPD asking for public's help

CULLMAN - The CVS Pharmacy at 1906 Cherokee Ave. SW in Cullman was robbed Thursday night, and Cullman Police are asking for the public's assistance- HAVE YOU SEEN THIS VEHICLE? The car has a white driver's side door.

According to Lt. Gene Bates, all of the CVS employees are OK.

Bates said the suspect, a male, entered the store at approximately 8:10 p.m., demanding oxycodone.

"He came in, demanding oxycodone," said Bates. "He did get 32 pills."

Bates said employees believe the suspect was wearing a disguise.

He said the scene has been processed, and that Sgt. David Nassetta and Sgt. Todd Chiaranda are involved in the investigation.

"The best chance we have of finding him is the vehicle," said Bates. "Whether tonight or in the morning, if someone recognizes the vehicle or knows where it is, please contact the police department."

Cullman man indicted for counterfeiting

BIRMINGHAM– A federal grand jury on Friday indicted two north Alabama men in unrelated counterfeiting cases, announced U.S. Attorney Jay E. Town and U.S. Secret Service Special Agent in Charge Michael Williams.

A five-count indictment filed in U.S. District Court charges Connor Douglas Glass, 25, of Cullman, with making counterfeit $100 and $20 bills in Cullman and Jackson counties between January 2017 and October 2017. The indictment also charges Glass with possessing counterfeit $100 and $20 bills on Oct. 27, 2017, in Jackson County. The indictment charges Glass with separate counts of passing counterfeit bills at three different Dollar General Stores in Cullman and Jackson counties. Glass was aided by others in passing the counterfeit money, according to the indictment.

An unrelated indictment charges Montrez Chebeir Martin, 33, of Huntsville, with three counts of passing counterfeit $50 bills to separate individuals in Madison and Morgan counties in September 2017. The indictment identifies the individuals only by initials.

A fourth count of the indictment against Martin charges him as a convicted felon in possession of a handgun, a Smith & Wesson .40-caliber, on Sept. 3, 2017, in Morgan County. According to the indictment, Martin was convicted of second-degree theft in state court in Iowa in 2014 and of second-degree assault in Madison County, Ala., Circuit Court in 2017.

Each of the counterfeiting charges carries a maximum penalty of 20 years in prison and a $250,000 fine. The charge of being a convicted felon in possession of a firearm carries a maximum penalty of 10 years in prison and a $250,000 fine.

The Secret Service investigated the cases, which Assistant U.S. Attorney Davis Barlow is prosecuting.

Overnight shooting in Cullman sends 2 to hospital

CULLMAN - A shooting overnight in the city of Cullman resulted in two people being transported to Huntsville Hospital. The incident happened on Adelsheim Circle Southwest at approximately 1:20 a.m., according to Cullman Police Chief Kenny Culpepper.

Culpepper said he believes the shooting was a part of a domestic incident.

CPD Capt. of Investigation Becky Boyd said in a statement, "On May (3) at approximately 1:15 a.m. (the) Cullman Police Department responded to a domestic violence call at 2061 Adelsheim Circle in the city of Cullman. Once on scene officers found two victims of a gunshot. Both victims were transported to Huntsville Hospital, one by ambulance and one by Air Evac. This is still an active investigation and no further information will be released at this time. Lt. Gene Bates is the lead investigator."
