Monograms Plus burglarized early Wednesday; cash, jewelry taken

CULLMAN - Longtime Cullman Warehouse District merchant Monograms Plus was burglarized in the early morning hours of Wednesday, Nov. 22, by a man who was captured on surveillance cameras.

Cullman Police Department Lt. Gene Bates said the man, described by storeowner Margaret Hamm as white, wearing a camouflage cap, a black North Face hoodie and painter’s pants, made forcible entry to the business’ service entrance around 6:15 a.m. Store employees became aware of the burglary upon opening for business a short time later.

A noticeably upset Hamm spoke to The Tribune via telephone.

“We have him on tape,” she said. “He came in at 6:17 a.m. and he used a knife and a crowbar. He was in and out in five minutes.”

Hamm said the suspect took cash and a large amount of the store’s extensive Ronaldo jewelry collection.

The value of everything stolen is still being calculated, as the store has spent today doing an inventory, but Hamm estimates it will be “several thousand dollars.”

“He was observed by employees of other businesses this morning,” Hamm continued, “and we’ve already had deadbolts installed today.”

On a more personal note, Hamm said, “You know, we (the staff) spent last night shopping for our church’s angel tree and then had dinner together…then to come in this morning to this…”

Monograms Plus is located at 103 First Ave. NE Ste. 120.

Said Bates, “Sgt. Eric Cole is the lead on this investigation. If anyone has any information, they can call the police department and speak to Sgt. Cole.”

Reach the police department at 256-734-1434.

Hanceville man arrested again for sex crimes involving minors

Brandon William Brown / Cullman County Sheriff’s Office

CULLMAN - A Hanceville man, already behind bars on charges of second-degree rape and second-degree sodomy for crimes involving a minor, was arrested again over the holiday weekend, this time on a warrant for sexual abuse of a child under the age of 12.

Brandon William Brown, 20, is in the Cullman County Detention Center on a $55,000 property bond.

The Cullman County Sheriff’s Office (CCSO) said, “These are two separate cases and two separate victims.”

Brown was arrested on Oct. 11, 2017 for the first two charges.

“I would like to thank the Child Advocacy Center for their commitment to keep children safe and to get them the help they need," said Sheriff Matt Gentry. “I would also like to thank our investigators who worked on this case.”

Because of the nature of the crimes, and because the victims involved are minor children, the CCSO declined to release further details.

CULLMAN - The man who allegedly shot and killed his stepfather before reportedly turning the gun on himself Sunday, Nov. 12, is awake, according to Cullman Police Department Sgt. David Nassetta. William Thomas Maddux, 27, who had been listed in critical condition at UAB Hospital since the incident, is now under psychiatric care at the medical center.

“He is awake,” said Nassetta on Monday afternoon. “From what we’ve been told he is awake and is talking, but he is still talking about harming himself, so they’ve got him on the psychiatric floor.”

The deadly double shooting occurred at 1829 Cottonwood Dr. SE in the Carrol Acres subdivision in the city of Cullman. Lt. Gene Bates confirmed in the hours following the incident that the two people shot were stepfather and stepson. Cullman County Coroner Jeremy L. Kilpatrick identified the deceased as Perry Shoemake, 56, of Cullman.

Said Nassetta, “We want to talk to him (Maddux). We’ll probably get a warrant and he’ll be arrested. We just have to wait and see what his status is.”

As to what charges Maddux will be facing, Nassetta would not speculate. “That will be up to the D.A. (Wilson Blaylock). He’ll look over everything and decide.”

Nassetta told The Tribune on Nov. 13, "What we believe is that the suspect, who is also the stepson of the man who is deceased, attempted to come into the house. He was not let in. The suspect ended up coming back and breaking in the back door of the house. He came in and there was an exchange of gunfire. The suspect then attempted to commit suicide. He suffered a self-inflicted gunshot wound to the head."

As to a possible motive for the shooting, Nassetta said the preliminary investigation has revealed that Maddux was upset because his mother and stepfather would not give him money, but said he thinks there's a lot more to it than that. "That's a pretty big leap to make," he said, "going from being upset over money to shooting someone and attempting to kill yourself."

Maddux was airlifted to UAB Hospital shortly after the incident occurred.

Bates said no one else was injured, although there was someone else at home when the shooting happened.

EXCLUSIVE: Spike in number of animal cruelty cases concerns authorities

$

Cullman County Animal Control Sgt. Chris Westmoreland said the department usually doesn't publish photos of animals involved in cruelty cases, but said Friday, "Maybe it's time for people to see this." The department has been inundated with cases over the last several weeks. Shown are two of the dogs seized in the Garrison/James case (top row); one of the dogs seized in the Floyd case (bottom left) and one of the dogs seized in the Looney case (bottom right). Cullman County Animal Control Director, Capt. Tim McKoy, encourages residents to contact Animal Control if they see animals in a condition similar to the ones shown in these photographs.  / Cullman County Animal Control

CULLMAN - There has been an alarming spike in the number of animal cruelty cases in Cullman County. According to Cullman County Animal Control Sgt. Chris Westmoreland, in a three-week span beginning Oct. 23, 12 people were arrested in five separate cases, and 28 animals were seized

“It was a very odd month,” said Westmoreland.  “We work a lot of animal cruelty cases, but we can usually get most of the owners in compliance.  But (the seized animals) were bad enough that we needed to take them at that point and get them to a vet.”

The following list includes one case from September, and those involved in the October/November spike of incidents.

  • Mark Kevin Bassett, 48 - cruelty to animal (horse), a Class A misdemeanor; case pending

This incident occurred on County Road 1635.

Westmoreland said that in this case, officers responded to a report in September of a horse in poor condition. “It takes a lot longer to put weight on a horse than on a canine, just because of their mass,” he said. “The owner was advised by a local vet how to care for the animal. He did not follow through. The condition of the horse deteriorated.”

  • Ashton Henil Floyd, 23 - cruelty to dog/cat (2 counts), Class A misdemeanors; case pending
  • Thomas Michael Floyd, 32 - cruelty to dog/cat (2 counts), Class A misdemeanors; case pending

This incident occurred on County Road 496.

The Floyds’ case involves two canines. “We had multiple contacts with them,” said Westmoreland, “from running at large, to not having water, to not having access to shelter. We made multiple attempts to get them into compliance. Some of the animals were brought into compliance; some were not. We seized two dogs.”

  • Tina Marie Garrison, 26 - cruelty to dog/cat (8 counts), Class A misdemeanors; sentenced to 15 days in jail
  • Jonathan Eugene James, 31 - cruelty to dog/cat (8 counts), Class A misdemeanors; sentenced to 30 days in jail

This incident occurred on County Road 1619.

“They had a couple of emaciated dogs on the property,” said Westmoreland. “Those two dogs, along with another one, were in very poor shape. I made contact with the owners, who said their dog food had gotten stolen, and they hadn’t bought anymore.”

Westmoreland said that at that point, the dogs needed to be seized and taken to the vet.

“We had an understanding that they needed to take the rest of the dogs to the vet by a certain date, and they didn’t do it. We seized six more dogs and took them to the vet. All of the animals test positive for parasites. The judge awarded custody of the eight dogs to the animal shelter.”

  • Kallie Jordan Suzanne Looney, 26 - cruelty to animals (6 counts), Class A misdemeanors; case pending

This incident occurred on County Road 52.

“We got the complaint around the first of August,” Westmoreland said, “that a dog was a little thin and suspected to be parasitic. We talked with the owner and she agreed to take the animal to the vet, which she did; she took care of it.”

Eight weeks later, officers got another call. “Within a matter of weeks, everything went downhill. She was not taking care of them like she should. We seized six canines.”

  • Terry Brian Massey, 41 - cruelty to animals, allowing dogs to run at large, Class A misdemeanors; case pending
  • Elizabeth Temple Melton, 35 - cruelty to animals, allowing dogs to run at large, Class A misdemeanors; case pending

This incident occurred on County Road 1511.

Westmoreland said this was a case of a dog unconfined to the property, which had tragic consequences.

“They had been warned multiple times of the animal being loose,” he said. “The animal ultimately died due to their criminal negligence.”

  • Brandon Steven Smith, 30 - aggravated cruelty to animals (2 counts), Class C felony; cruelty to dog (6 counts), Class A misdemeanor; case pending
  • Carolyn Sue Smith, 54 - aggravated cruelty to animals (2 counts), Class C felony; cruelty to dog (6 counts), Class A misdemeanor; case pending
  • Jeffery Allen Smith, 29 - aggravated cruelty to animals (2 counts), Class C felony; cruelty to dog (6 counts), Class A misdemeanor; case pending
  • Ronnie Steven Smith, 26 - aggravated cruelty to animals (2 counts), Class C felony; cruelty to dog (6 counts), Class A misdemeanor; case pending
  • Tony Steven Smith, 53 - aggravated cruelty to animals (2 counts), Class C felony; cruelty to dog (6 counts), Class A misdemeanor; case pending

Due to this being an active felony case, Westmoreland was limited in the amount of details he could share.

“All I can say is that the day after Thanksgiving, we were dispatched to County Road 233 on the report of a deceased animal. When we got on the scene, were found two deceased canines confined to property. There were six other canines that were in poor condition, some more than others. At that time, we made the determination to seize all the animals.”

Westmoreland said the six live dogs were taken to the vet for treatment, while the two deceased canines were taken to the Wallace State Community College diagnostic lab for necropsies.

The defendants in this case face possible jail time.

Said Westmoreland, “If you live in Cullman County, it doesn’t cost anything to bring an animal to the shelter. You need to do something other than let these animals sit out and suffer.”

Cullman County Animal Control Director, Capt. Tim McKoy, encourages residents to contact Animal Control if they see animals in a condition similar to the ones shown in these photographs*, so personnel can go and check on the animals.  Efforts will be made to bring owners into compliance where possible, but animals will be seized to protect the animals’ health or safety, if necessary.

TN man arrested for murder by Cullman Police

William Lynn Smith / Cullman Police Department

CULLMAN - A Trenton, Tennessee man was extradited over the weekend and brought to Cullman to face two murder charges. The arrest stems from an incident that occurred at the Days Inn off U.S. Highway 278 West in March of this year, when the body of Jeanie Kent, 47, also of Trenton, was found.

William Lynn Smith, 43, has been charged with murder and first-degree domestic violence (murder), according to Cullman Police Department Sgt. Scott Sanford, who is the lead on the case.

“On March 25 of this year, we were called to the Days Inn on Highway 278, where a deceased female was found,” said Sanford. “It was discovered that the room was actually rented in the name of William Smith.”

Sanford said the investigation has taken several months. He could not release particular details of the case, but said, “I believe they argued, and that resulted in her losing her life.”

Neither drugs nor alcohol are suspected to have played a part in the incident.

Shared Sanford, “The suspect and the victim had been involved in a relationship for several, several years. It was on-again, off-again, and wasn’t easy-going.”

At the time Kent’s body was found, Smith had left the area and returned to Trenton.

Smith is being held in the Cullman County Detention Center on a $60,000 cash bond.

He is awaiting a preliminary hearing.
