Latest: Steve Griffith’s wife, Jackie Griffith, in good condition following fatal home invasion

CULLMAN - The third person involved in Monday night’s fatal home invasion was officially identified late Wednesday afternoon as Jackie Griffith, the wife of local attorney Stephen K. Griffith, who tragically lost his life in the attack at the Griffith’s home on County Road 1301 in north Cullman County.

Stephen Griffith, 73, of Vinemont, was a prominent Cullman attorney. The assailant has been identified as Patrick O. Walker, 45, of Jones Chapel. Cullman County Sheriff Matt Gentry confirmed Monday night that Stephen Griffith was shot. He did not elaborate on the assailant's manner of death.

The deadly incident occurred sometime after 5 p.m. Monday, July 17, according to Gentry.

Speaking on behalf of Cullman Regional, where Jackie Griffith is being treated for her injuries, and the Griffith family, Cullman Regional’s Lindsey Dossey briefly addressed the media.

“First, on behalf of the hospital administration, I want to acknowledge and thank Sheriff (Matt) Gentry and his team for the professional and compassionate job that they have done with this case,” began Dossey.

“Also, I just want to remind the media that due to HIPPA rules and regulations, that there is very limited information that we can share from the hospital; however, due to the high-profile coverage and the outpouring of love and compassion by our community, the family has agreed to share some very limited details, and so I’m going to be reading a prepared statement. If there’s a couple of questions afterwards, you can ask; I cannot make any promises that I’ll be able to answer those.

“The patient, Jackie Griffith, is being treated by our medical team and remains in good condition. She and the family want to thank the community for their prayers, but they also ask that everyone respect their privacy as they continue to heal and mourn through this process.”

Dossey confirmed that Jackie Griffith is Steve Griffith’s wife and that she is in good condition.

“I would say our community is a very loving, compassionate community. In times of need, we come together. And so, I think that the family understands and appreciates the fact that our community just wants to love them and pray for them during this time.

“I think, we have seen that a lot, over the last few days, and I anticipate that they will continue to see that. Because that’s what our community is really good at. We’re good at loving each other.”

Gentry, still visibly affected by the ordeal, held a press conference Tuesday afternoon about the incident. He spoke candidly, and with passion, about what he feels is the state’s failure to properly care for its mentally ill citizens.

“A little bit after 5 p.m. yesterday, a little bit kind of close to 6, an individual that we’ve identified as Patrick Walker went to Mr. Steve Griffith’s residence with the intention of killing him,” said Gentry. “He went inside the residence and shot Mr. Griffith. At this time, there was another occupant (now identified as Jackie Griffith) in the residence, who then ensued in a struggle with Mr.  Walker, and after a long struggle, killed Mr. Walker.”

He continued, “This is a subject that we’ve talked about many times. It’s a subject that makes me angry to talk about, and that’s mental illness. Through the investigation, our investigators have worked throughout the night, and are continuing to work. What we have identified (is) that in 1997, there was a case involving Mr. Walker, and for the last decade he believed that the victim had a part to play in a case that he was involved in. We’ve identified that Mr. Walker had mental issues. Mr. Walker became infatuated with Mr. Griffith, even though they had no connection. There was no connection between the two. And yesterday, that mental illness led Mr. Walker to Mr. Griffith’s residence, in which he took his life.”

Said Gentry, “In Mr. Walker’s mental state, he believed there was a connection. There was not.”

Since early Monday evening, there have been rumors swirling around town and on social media about the details of the incident. Gentry addressed those directly.

“One of the things I want to do is clear up a lot of rumors. This was not a murder for hire,” he said. “This was a product of the failure of our society. This was a product of someone with mental illness not getting treated. This is (an) issue that we’ve talked about many times. It’s an issue that makes me angry. It’s an issue that law enforcement and the victims, our citizens, deal with every day. And it’s an issue that we need to stand up as a community and fix. We’ve talked about it numerous times. We’ve all been here together. How many times have talked about law enforcement being in standoffs, law enforcement being in shootouts with mentally ill. Our citizens getting hurt. This is another prime example where we, as a whole, failed the system. The system is failing our citizens.”

On the current state of mental healthcare, Gentry said, “Today, outpatient is the best scenario you can give someone. Well, outpatient doesn’t work. You can’t trust that person to take care of themselves. You can’t trust that that person will take their medication. You need long-term treatment for these individuals.”

Gentry confirmed that Walker had been treated in the past, “in the last 20 years.”

According to the sheriff, Walker walked into Griffith’s home Monday night with his own weapon, a pistol, which he was legally allowed to own.

But, even if he weren’t allowed, Gentry said, “If a bad guy wants a gun, a bad guy’s going to get a gun. If I’m a bad guy, I can go on the street and get one.”

The sheriff’s office is not releasing any details about how Walker was killed, with Gentry saying only, “He was not shot.”

He shared, “Cullman County is a great community. We’re a very tight-knit community. I have people come to my house every day. I know some. Some I don’t.

“We live in a community where we help each other. It’s not uncommon for citizens in Cullman County to know that maybe somebody’s an attorney, someone’s in law enforcement. Hey, they come to your house to ask for help. That’s not an uncommon practice in our community. We live in a great community, where our main focus is to help each other.”

The incident took place on County Road 1301 in north Cullman County.

Asked to speak about his relationship with the victim, Gentry, obviously emotional, said, “I’m going on my 18th year in law enforcement; I have many friends. Steve Griffith was my friend.”

Griffith was a longtime attorney in Cullman, and was most recently a partner in the law firm of Griffith, Lowry & Meherg. He also served as a member on the Cullman County 911 Board. According to his firm's website, Griffith had practiced law for 49 years.

The firm released the following statement: “Our hearts are broken. We have lost our senior partner, our mentor, our friend. No one will ever be able to replace Steve Griffith. He was larger than life. We will miss him more than words can express. Our hearts and prayers go out to Steve’s family.”

Cullman Heritage Funeral Home posted Steve Griffith's obituary and service arrangements online Wednesday: "Mr. Griffith will lie in state at St. John’s Evangelical Protestant Church on Saturday, July 22, 2017 from 11 a.m. until 2 p.m. with a memorial service immediately following. In lieu of flowers, the family requests donations may be made in memory of Stephen K. Griffith to Big Oak Ranch (P.O. Box 507 Springville, AL 35146) or St. John’s Evangelical Protestant Church (512 2nd Avenue Cullman, AL 35055)."

Local optometrist arrested for harassment

CULLMAN - A local optometrist was arrested Friday on one count of harassment after a patient swore out an affidavit against him and a warrant was issued by the magistrate’s office.

Dr. Phillip Guthery, 66, a resident of Gardendale, was arrested at his place of business, the Family Eye Clinic, at 100 Seventh St. SW in Cullman.

According to court documents, Guthery allegedly grabbed the victim, described by police as “a female in her 50s or 60s,” by the face and kissed her, then “grabbed her breast and genital area.”

Cullman Police Sgt. David Nassetta, the lead investigator on the case, said, “We were able to corroborate enough to warrant the harassment charge.”

Nassetta was not able to disclose how the department corroborated the victim’s story.

The alleged incident took place at the eye clinic.

Nassetta says Guthery was arrested and bonded out on the same day.

According to part A of Section 13A-11-8 (A) of the Code of Alabama, 1975:

(a)(1) HARASSMENT. A person commits the crime of harassment if, with intent to harass, annoy, or alarm another person, he or she either:

a. Strikes, shoves, kicks, or otherwise touches a person or subjects him or her to physical contact.

b. Directs abusive or obscene language or makes an obscene gesture towards another person..

(2) For purposes of this section, harassment shall include a threat, verbal or nonverbal, made with the intent to carry out the threat, that would cause a reasonable person who is the target of the threat to fear for his or her safety.

(3) Harassment is a Class C misdemeanor.

Cullman woman arrested after drugs found in apartment

CULLMAN - A Cullman woman was arrested recently after a search of her home allegedly yielded hydrocodone pills and multiple items of drug paraphernalia. Lindsay Nicole Schmale, 35, was arrested at her apartment on the southwest side of town by Cullman City Police Department Sgt. Chris Thomason, along with Officers Dustin Colburn, Cole Kelley and Trey Higginbotham. 

The officers went to Schmale's home after receiving complaints of drug activity.  After speaking with Schmale, they obtained her consent to search her residence. That's when they found 19 hydrocodone 10mg pills (a Schedule 2 controlled substance) and multiple items of drug paraphernalia, including marijuana and methamphetamine pipes. 

Schmale was arrested and charged with possession with intent to distribute a controlled substance and unlawful possession of drug paraphernalia.  She was taken to the Cullman County Detention Center and has since bonded out.

CCSO: 8 arrested for drugs on 2 separate search warrants

CULLMAN COUNTY - Agents with the Cullman Narcotics Enforcement Team (CNET) and investigators with the Cullman County Sheriff’s Office (CCSO) on Thursday arrested eight individuals after two search warrants led to the discovery of drugs.

In the first incident, a search warrant was executed early Thursday morning on County Road 335 close to Miller Flats on Smith Lake.  Allegedly discovered were 4 grams of methamphetamine and 3.5 grams of hydrocodone.

Four people were arrested and charged with two counts each of unlawful possession of a controlled substance and unlawful possession of drug paraphernalia. Each had a bond of $9,000.

In the second incident, which happened later Thursday, a search warrant was executed on County Road in the Bremen community. There, various Schedule 2 and Schedule 3 pills were allegedly discovered, along with drug paraphernalia.

Four people were arrested. Their charges and bond amounts are below:

  • Donald William Holder, 49, of Bremen- unlawful possession of a controlled substance and unlawful possession of drug paraphernalia- $5,000 bond
  • Shelly Dawn Holder, 49, of Bremen- unlawful possession of a controlled substance and unlawful possession of drug paraphernalia- $5,000 bond
  • Kimberly Johnson Graves, 50, of Bremen- unlawful possession of drug paraphernalia- $1,000 bond
  • Bradley Dewayne Hester, 35, of Bremen-  unlawful possession of drug paraphernalia- $1,000 bond

In all, the CCSO seized more than 4 grams of methamphetamine, 3.5 grams of hydrocodone, various Schedule 2 and Schedule 3 pills, and various items of drug paraphernalia.

“Anytime you can arrest this many drug offenders, that’s a good day. We have gotten some tips from citizens about drug activity and we have really been concentrating on drug suppression in these areas,” said Sheriff Matt Gentry. “I would like to thank the CNET agents and our investigators for all they did yesterday.”

All suspects are currently being held in the Cullman County Detention Center.

Sheriff's Office warns of new phone scam

CULLMAN -  The Cullman County Sheriff's Office received several calls from Cullman County residents Friday saying that people are calling and claiming to be with the Cullman County Sheriff’s Office and that the resident of Cullman needs to pay them a fine or pay for a bond over the phone. This is all a SCAM.

The CCSO never calls anyone over the phone to collect money. The callers have foreign accents.

Please make your elderly family members aware as they target them the most.

2 arrested for impersonating Cullman Police officers

CULLMAN - Two men were arrested on Wednesday in a bizarre incident in which both allegedly identified themselves as officers with the Cullman Police Department to a couple in a domestic dispute at Veigl Village Apartments on the southwest side of the city of Cullman.

Terry L. Hayes, 40, of Thorsby and Larry W. Smith, Jr., 36, of Cullman were charged with impersonating a peace officer.

According to CPD Investigator Scott Sanford, a couple was involved in a minor domestic dispute at the apartment complex, when Hayes and Smith approached them.

"The two male subjects said they were officers," said Sanford.

Upon noticing that the male involved in the domestic dispute was armed, Hayes and Smith allegedly told him to keep the weapon where it was.

"They had badges that said 'Security' on them and had handcuff pouches," Sanford said.

While all of this was going on, according to Sanford, the CPD had been called.

"According to Mr. Smith, the male subject involved in the argument began to walk away and actual police officers began to arrive. No handcuffs were placed (by the impersonators)."

Sanford said Officer Philip Botelho made the arrests.

Cullman County Sheriff’s Office partners with Crime Stoppers

CULLMAN - The Cullman County Sheriff’s Office is partnering with Crime Stoppers of Metro Alabama (CSMA). On Tuesday morning, Sheriff Matt Gentry held a press conference to announce the details. CSMA partners with eight counties: Bibb, Blount, Chilton, Jefferson, Shelby, St. Clair, Walker and now Cullman. Gentry was optimistic about the opportunities provided by the partnership, saying it will provide an avenue for citizens to step in and help keep the county safe.

Crime Stoppers is a partnership between law enforcement agencies, news media and private citizens. Its goal is to gather information to help law enforcement solve crimes and locate criminals with outstanding felony warrants. CSMA solicits anonymous tips from the community and forwards those tips to the relevant investigating agency. Successful tips can result in a cash reward between $300-$5,000, depending on the severity of the crime and the number of crimes solved from the tip. Tipsters remain 100 percent anonymous.

Since its inception in 1981, CSMA has helped local law enforcement make more than 2,400 arrests, clear more than 5,800 cases and approved more than $818,000 in rewards. Numbers of arrests and cleared cases have risen steadily over the years, and CSMA anticipates more than 1,000 arrests and 2,000 cleared cases for 2017.

When asked how the partnership will affect him as sheriff, Gentry replied, "This is an investigative tool that we need to reach other locations besides Cullman County. With us having so many miles of I-65 in the county, we have so many people coming in that aren't from Cullman, and this just gives us a broader band of reach." He also said that the expanded reach would help identify and catch criminals who may have fled to another county.

ATF offers reward in gun store theft

Persons of interest in the theft of firearms from Pawn Your Bond, 1506 County Road 437/ ATF

CULLMAN - The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) in conjunction with the Cullman County Sheriff’s Office and the National Shooting Sports Foundation (NSSF), the trade association for the firearms industry, are offering a reward for information leading to the arrest and conviction for those responsible for the theft of firearms from Pawn Your Bond, a federal firearm licensee (FFL).

On Aug.6, 2017, Pawn Your Bond, 1506 County Road 437, Cullman, was burglarized and approximately seven firearms were reported stolen to the Cullman County Sheriff’s Office. ATF industry operations investigators are in the process of conducting an inventory to determine the exact number of firearms stolen.

ATF is offering the reward in the amount of up to $2,500, which will be matched by the NSSF for a total reward of up to $ 5,000, for information regarding this crime. Anyone with information about this crime should contact the ATF at (800) ATF-GUNS (1-800-283-4867) or the Cullman County Sheriff’s Office 256-734-0342.  Information can also be sent to ATF via the mobile app www.reportit.com by using the Nashville field division as the location.

This reward is part of a larger national cooperative initiative between the NSSF and ATF in which NSSF matches ATF’s reward in cases involving the theft of firearms from federally licensed firearms retailers. ATF works closely with members of the firearm industry to curb the criminal acquisition and misuse of firearms.

ATF is the lead federal law enforcement agency with jurisdiction involving firearms and violent crimes, and regulates the firearm industry.  More information about ATF and its programs is available at www.atf.gov.

2 arrested for selling meth to undercover cops

CULLMAN -  Two Berlin residents were arrested this week after they allegedly sold methamphetamine to undercover cops. The operation was conducted by Cullman City Police Department Investigator Justin Craft and Lt. Jody Martin.

On Aug. 9, CPD Narcotics Investigators Craft and Scott Sanford arrested Jesse Dean Thomas, 34. Ronnie Regina Millar, 35, was arrested by Craft on Aug. 10. Both Thomas and Millar were charged with unlawful distribution of a controlled substance.

According to the CPD, both subjects were previously arrested for drug charges in late June.

Following this week’s arrests, Thomas was jailed on a $30,000 property bond and bonded out after three hours. Millar, also given a $30,000 property bond, is still being held at the Cullman County Detention Center at the time of this report.
