Hudson denied youthful offender status in Osborn murder; Maresh claiming mental disease or defect

CULLMAN - On Tuesday afternoon, Tyler Hudson, who was arrested with Andrew Maresh in March for the murder of Daniel Ray Osborn, Jr., saw his motion for youthful offender (YO) status denied by Circuit Judge Martha Williams, according to a source inside the courthouse.

At the time of their arrests, Maresh was 19 and Hudson was 20.  Defendants who are younger than 21 at the time of the offense with which they are charged can qualify for YO status, but courts have discretion in their decisions under Alabama Code Section 15-19-1.  YO status focuses on rehabilitation of the offender, and keeps the crime off the offender’s public record, even in the case of a conviction. If a defendant qualifies as a YO, the penalty of a guilty verdict can be significantly reduced, with prison sentences not to exceed three years.

YO requests often consider the defendant’s prior criminal history, role in the offense, seriousness of the offense and potential for rehabilitation, among other factors.  

Maresh pleads not guilty by reason of mental disease or defect

Maresh also applied for YO status over the summer, and saw his request denied on Aug. 14.  A short time later, he added to his initial not guilty plea an additional plea of not guilty by reason of mental disease or defect.   Williams ordered Maresh to undergo an outpatient evaluation by a psychologist or psychiatrist from the Alabama Department of Mental Health and Mental Retardation.  His case is currently continued pending the outcome of that evaluation.

Osborn’s body was found buried on the Fairview property of Susan Winton Smith, Maresh’s grandmother, on the afternoon of March 26, 2018.  Court documents revealed that Osborn died of a gunshot wound to the back of his head. Hudson and Maresh were arrested and charged with murder that evening.  Smith was later charged with hindering prosecution, and more recently with murder in the case.

A Cullman County Sheriff’s Office report available on Alacourt indicates that Maresh claimed that Hudson pulled the trigger, and that he had nothing to do with the murder.  Maresh later changed his statement to say that he had helped bury the body but continued to deny involvement in the murder.

(Updated) Shooting in Garden City; CCSO searching for suspect

Update 9-21-18 8:45 a.m.

The CCSO is actively searching for the shooting suspect, identified by as Joshua Finley.

Finley is a white male, 31 years old, 6' tall, 230 pounds

Finley was last seen wearing blue jeans and a blue shirt.

He was last seen between Crosshaven Church and Cullman Golf Course.


GARDEN CITY - Authorities are on the scene of a shooting in Garden City, the Cullman County Sheriff's Office (CCSO) confirmed.

At least one person was injured and transported by helicopter to an area hospital.

A spokesperson for the CCSO said Sheriff Matt Gentry will update the public as details become available.

This is a developing story.

Shooting suspect in custody following manhunt; charges pending

GARDEN CITY - The suspect in an early-morning shooting in Garden City is in custody following a manhunt that lasted approximately four hours Friday. Joshua Finley, 31, was tracked down in the woods by the Cullman County Sheriff’s Office (CCSO) K-9 tracking team, led by K-9 Deputy Clara Bell, CCSO deputies and Cullman Police officers.

The shooting happened at a residence in Garden City around 6:30 a.m.

“Within a couple minutes deputies were on scene,” said Cullman County Sheriff Matt Gentry.

One person was shot. The victim was airlifted to a hospital in Birmingham where he is listed in critical, but stable condition.

Finley, who also had an active burglary warrant, fled the scene of the shooting. His vehicle was located off County Road 594, and the search concentrated in the area between Cross Creek Golf Course and Crosshaven Church.

“One of the things I want to make note of is how proud I am of the deputies and investigators,” said Gentry. “They were relentless this morning, from the time it started at 6:30, they never stopped. If you saw some of the guys coming out of the woods, they were scratched with briars. We utilized a lot of resources. We had our K-9 tracking team, Clara Bell, she was on the scene, with the city helicopter. We had city police officers and deputies and investigators. That’s the reason we have a positive result and the arrest of Finley now.”

Gentry credited the Cullman Police and particularly the CPD’s helicopter, with helping contain Finley. He said the K-9 tracking team then went down in the woods and located Finley.

“Finley was not injured besides scratches from briars; the deputies were just as scratched up as he was,” said Gentry. “Once deputies laid hands on him, he quit any resistance.”

A CCSO deputy who assisted in the manhunt is receiving medical care for 20 yellow jacket stings sustained in the search.

Gentry said multiple witnesses are being interviewed about the shooting. He said Finley and the victim were acquaintances.

The CCSO will consult with the Cullman County District Attorney’s Office to discuss which charges Finley will be facing.

More information is expected.

Hanceville Police seize cash, weapons, 27 pounds of marijuana

The Hanceville Police Department seized 27 pounds of marijuana, $10,000 and multiple firearms after serving warrants Monday and Tuesday. The first arrest in the case was Joshua Lott, pictured. (Hanceville Police Department)

HANCEVILLE - The Hanceville Police Department seized 27 pounds of marijuana, $10,000 in cash and multiple firearms this week, according to Assistant Chief Adam Hadder, who said it was the result of warrants served at three different locations Monday and Tuesday.

One arrest has been made so far. Joshua Gerald Lott, 28, of Hanceville was arrested Tuesday at a residence on Linda Warren Circle. Hadder said 7 pounds of the marijuana and two of the firearms were found at the residence.

Lott was charged with trafficking in illegal drugs. He was booked into the Cullman County Detention Center and has since been released.

Hadder said more arrests are pending in the ongoing investigation, which is targeting marijuana traffickers who are traveling to California or Colorado and then driving back with the drugs or having them shipped back, sometimes to their own residences, but usually to stash houses in the area. He said there are three to four more stash houses, in addition to the three residences searched this week.

According to Hadder, Lott has been receiving 5-7 pounds of marijuana per week for the past year.

Hanceville man charged with attempted murder in Garden City shooting

CULLMAN - A Hanceville man is facing an attempted murder charge following a shooting in Garden City Friday. Joshua Dewayne Finley, 31, is also charged with first-degree assault and third-degree burglary.

Finley was the target of a nearly four-hour manhunt Friday, Sept. 21 after he allegedly shot someone at a residence in Garden City at approximately 6:30 a.m. that morning.

The victim, who was airlifted to a Birmingham hospital, has not been identified.

Finley, who also had an active burglary warrant, fled the scene of the shooting. His vehicle was located off County Road 594, and the search concentrated in the area between Cross Creek Golf Course and Crosshaven Church.

He was tracked down in the woods by the Cullman County Sheriff’s Office (CCSO) K-9 tracking team, led by K-9 Deputy Clara Bell, CCSO deputies and Cullman Police officers.

Finley remains in the Cullman County Detention Center on a $150,000 cash bond.

Doug Doggett Jewelers burglarized

CULLMAN - Cullman’s Doug Doggett Jewelers was burglarized early Wednesday morning, confirmed investigators with the Cullman Police Department.

CPD Lt. Gene Bates said a “large amount” of merchandise was taken.

Owner Deanna Doggett Millican stated that the burglary, the first in the store’s 36 years, happened between 1:15 and 1:30 Wednesday morning. The glass in the front door of the business was busted out.

“Everybody is safe, so that’s all that matters,” she said.  “We are still inventorying. No customer merchandise was taken. It was all stock merchandise.”

The store is closed Wednesday while glass is replaced, inventory is completed, and the store is cleaned up.  

“The police department’s been great,” said Millican.  

Doug Doggett Jewelers is located at 215 Compass Way SW.

Sgt. Intae Suh and Bates responded to the initial alarm call. Suh is leading the investigation.

Hanceville mayor speaks out about marijuana arrests

HANCEVILLE - At the Hanceville City Council meeting Thursday evening, after Police Chief Bob Long reported on recent drug arrests in the area, Mayor Kenneth Nail took a moment to respond to several people who had used social media comment threads attached to local news outlets’ stories of the recent marijuana-related arrest of Hanceville resident Gerald Lott (see www.cullmantribune.com/articles/2018/09/21/hanceville-police-seize-cash-...) to argue for the legalization of the drug and to berate the City and its police department for pursuing marijuana dealers in the face of so many other dangerous drugs.

Comments on The Tribune story included:

  • “They don't have anything better to spend tax dollars on?  Go get some real criminals.”
  • “Weed? This is a joke. How about get the meth off the streets!!!”
  • “Gerald lott is an outstanding person this is absolutely ridiculous!!! Hanceville police department is a joke and is only trying to look big and bad bunch of Barney fiffes!”
  • “I have lost even more respect for law enforcement. They need to go after people that rob places, murder people, molest kids, etc.”
  • “Down with the Hanceville Police Department.”

Nail’s response was blunt and to the point: As long as marijuana is illegal, the police department will arrest people caught with it and will pursue dealers.

Chief Long reported to the council about the three-month investigation that led to the recent arrest, then stated, “I’m not sure if you guys are really aware of it or if you remember, but over the last two years, HPD’s been responsible for seizing approximately 200 pounds of marijuana, three pounds of meth, a couple of pounds of cocaine, and nearly $175,000 in U.S. currency, four or five vehicles, and possibly maybe we can file on one particular house.

“So you’ve got a small department, but you’ve got a good department.  And it started with patrol making routine traffic stops. It worked its way up through the drug chain, and we’ve hit some pretty good drug dealers over the last couple years.”

Responding to the comments on the arrest story, Nail added, “Look, I’ll be the first to say I’d a lot rather get meth or heroin, or whatever.  But (in) Alabama, it’s illegal to have marijuana, and I do believe it’s a gateway drug. And this police department is going to continue to seize marijuana, heroin, whatever is an illegal substance.  Now, if the voters in this state vote to legalize marijuana, then it’ll be a whole different issue.”

After commenting further on the effects of drug houses on residential neighborhoods, Nail concluded, “I just want to say, as long as we’re here and this police department’s here, we’re going to continue to do the best job we can.  And yes, I’d rather get heroin. Yes, I’d rather get the meth. But if the marijuana comes, we’re not going to look the other way. If you don’t like that, I’d just suggest that you move to Denver, Colorado maybe.”

High-speed chase in Cullman ends in arrest of 2, discovery of longtime forgery operation

CULLMAN - A high-speed chase down Alabama Highway 157 in the early morning hours of Monday, Oct. 1 ended in the arrests of two Huntsville woman and the discovery of a longtime forgery operation.

Cullman Police Department Sgt. Adam Clark said that after midnight Monday morning, Officer Kyle Foshee witnessed a vehicle pull out of Days Inn off U.S. Highway 278 West (1841 Fourth St. SW) at a high rate of speed and get onto Interstate 65.

“The vehicle got off at the 310 (exit),” said Clark. “Officer Foshee attempted to initiate a traffic stop on the vehicle due to it not having a tag on the vehicle, and the suspect then attempted to flee and then wrecked near the hospital, or just past the hospital.”

Clark identified the driver of the vehicle as Brittney Sloan, 32 and the passenger as Nakeishia Briggs, 39.

Foshee arrested both for attempting to elude and reckless endangerment. Allegedly found in the suspects’ possession were multiple forged checks and stolen identifications and debit cards.

“Sgt. Intae Suh and I were called in by Officer Foshee,” said Clark. “We wrote a search warrant for a room that we found out they were staying in at the Days Inn. When we searched the room, we found printers, blank checks, computers and other banking information.”

The search warrant was served around 11 a.m. Monday. Clark said Officer Roy Bates made contact with Days Inn after the chase and confirmed the suspects had rented the room with a fake ID, then stayed at the room until the warrant could be served.

Clark said Briggs is facing 21 charges and Sloan is facing 15. The charges, in addition to those from the traffic stop, include forgery, possession of a forged instrument, criminal possession of a forgery device, identity theft and possession of marijuana. More charges could be added, he said.

“Officer Foshee did a fantastic job, and it’s proactive police work like that that helped us catch these individuals,” said Clark. “These individuals are wanted by multiple other agencies, including the United States Marshal Service, and have been doing this apparently for a while.”

He continued, “Officer Foshee, not just last night, but day to day, he does a fantastic job. I can’t say enough about the work he does.”

Briggs and Sloan were booked into the Cullman County Detention Center, where they remain. Their bail amounts for the recent charges are unknown at this time, but they have holds with multiple other agencies, according to Clark.

Clark said a U.S. Secret Service agent responded this morning and helped serve the search warrant at the Days Inn. Along with Clark, Suh and Bates, Officer Justin Craft also assisted.
